====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Brahampur P.S. Case No. 472 of 2018 for the offenses under Section 30(a) of the Bihar Prohibition & Excise Act, 2016. Learned counsel for the petitioner submits that in the instant case total 34.460 ltrs of English Wine was recovered. Nothing was recovered from the conscious possession of the petitioner. The petitioner is in custody since 06.12.2019. Considering the fact that the alleged recoveries are not made from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.7660 of 2020(2) dt.05-02-2020 2/2 each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge (Excise), Buxar, in connection with Brahampur P.S. Case No. 472 of 2018. However, in the event the petitioner is found involved in similar cases in future, the court below shall be at liberty to cancel his bail bonds in the present case.
