The petitioner seeks bail in Goraul P.S. Case No. 194 of 2018, instituted for the offence under Section 414 of the Indian Penal Code, Sections 25 (1-b)a, 26 and 35 of Arms Act. It is alleged in the written report that Prince Kumar who was in custody has disclosed before the Police that Rs.50,000/- has been handed over to this petitioner. The police after getting information raided the house of petitioner and recovered Rs.50,000/- in different bundles and one country made pistol along with one cartridge from back side of the house of this petitioner kept hidden under the earth. Counsel for the petitioner submits that petitioner is
Patna High Court Cr.Misc. No.9113 of 2019(2) dt.18-02-2019 2/2 villager of co-accused Prince Kumar. The amount which has been recovered from his house belongs to him. He has withdrawn the aforesaid amount from the Bank, in support of which, he has enclosed Annexure-2 which is Pass-book of the account of the petitioner.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 194 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
