Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Sasaram Nagar P.S. Case No. 59 of 2016, registered for the offences punishable under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

The allegation against the present petitioner is that he became successful in obtaining the service on the post of Teacher by submitting forged documents.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.19870 of 2021(4) dt.24-03-2022 2/3 the present case has been lodged on the basis of order dated 11.05.2015 passed in CWJC No. 15459 of 2014 of this Court. Learned counsel for the petitioner has also submitted that in that order itself this Court has observed that the Education Department was directed to publish the notice that in case any teacher of whatever category has secured appointment on the basis of fake or fabricated certificates, submits his resignation within 15 days from the date of that notice, it would be accepted and no proceeding would be initiated against them either for prosecution or for recovery of the amount. Learned counsel has further submitted that as per direction of Hon'ble Court he has resigned from his service and this fact has been mentioned in paragraph No.

10 of this bail petition. He has also submitted that on similar footing some other accused persons have been granted anticipatory bail. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in connection with Sasaram Nagar (Model) P.S. Case No.

Patna High Court CR. MISC. No.19870 of 2021(4) dt.24-03-2022 3/3 to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
