JUSTICE HARISH KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 17-04-2026 In this writ petition filed by way of Public Interest Litigation, the petitioner, Rohit Kumar, has approached this Court seeking transfer of the investigation of Chitragupta Nagar (Patna) Police Station Case No. 14 of 2026, registered under Sections 126(2)/115(2)/76/109/3(5) of the B.N.S., to the Central Bureau of Investigation (C.B.I.) or any other law enforcement agency to ensure a fair, impartial, and efficacious inquiry, free from local influence or extraneous considerations.

2. When the matter was taken up on 08.04.2026, a submission was made on behalf of the learned counsel for the C.B.I. that it had already registered an F.I.R. in connection with Chitragupta Nagar (Patna) Police Station Case No. 14 of 2026. We asked the learned counsel for the C.B.I. to produce a copy of the F.I.R. registered by the C.B.I.

3. Today, learned counsel for the C.B.I., Mr. Shashank Chandra, has produced a copy of the F.I.R., which indicates that F.I.R. No. CBI/ACB/Patna RC0232026A0007 has been registered under Sections 126(2)/115(2)/76/109/3(5) of the B.N.S. Learned counsel further submits that the investigation of the case is under progress.

4. The statement along with other documents produced are taken on record.

5. In view of the fact that the investigation of the case has already been taken over by the C.B.I., we dispose of the writ petition accordingly.
