JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Town P.S. Case No. 198 of 2019, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 279, 338, 506 of the Indian Penal Code and later on added Section 302 of the Indian Penal Code.

Prosecution case is that motorcycle of the petitioner dashed the informant and, thereafter, he was assaulted by other accused persons and it is alleged that this petitioner ran over the tempo on his leg causing fracture injury to him. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case on a petty dispute of minor accident. Further he has no criminal antecedent and he has been in judicial custody since 12.12.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Town P.S. Case No. 198 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
