Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. Learned Senior Counsel very fairly at the outset submitted that out of eight prosecution witnesses, five prosecution witnesses have been examined, the said fact was agreed by the learned counsel for the informant even. Learned Senior Counsel, after some arguments, seeks permission to withdraw the present bail application. Permission is accorded with a direction to the learned court below to ensure that the trial be concluded within a period

No.53582 of 2021(2) dt.15-02-2022 2/2 of six months from the date of receipt/production of a copy of this order and further the Superintendent of Police, Purnea is directed that the official witnesses who remain to be examined must be produced before the learned court below in the trial as and when required, failing which it would be viewed that the prosecution is not interested in expediting the trial. Accordingly, this application is dismissed as withdrawn in connection with Jankinagar P.S. Case No. 66 of 2020 pending in the Court of learned Judicial Magistrate, 1st Class, Purnea.
