Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

Prosecution case, in brief, is that on 19.11.2022, while the informant was at his house, all the F.I.R. named accused persons including this petitioner arrived there and assaulted the wife of the informant on her head and took away ornament from her neck.

Learned counsel appearing for the petitioner submits that both parties are neighbours and due to petty dispute, scuffle took place between them in which wife of the informant sustained injury. Allegation of assault against the petitioner is

Learned counsel for the informant vehemently opposes the bail application.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Azamnagar P. S. Case No. 394 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
