JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 24.8.2014 in Tr.No.38/14 arising out of Inarwa P.S. Case No.64/14 for the offences under Sections 20, 22, 23, 24, 27 and 29 of N.D.P.S.Act. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that when on receipt of secret information the informant along with police party rushed to place of occurrence where he saw one person coming towards him, he caught him and 6 kg. substance like ganja was recovered from his bag.
It has been submitted on behalf of the petitioner that he is in custody since 24.8.2014. Charge sheet has already been
Patna High Court Cr.Misc. No.48387 of 2014 (8) dt.29-07-2015 2/2 submitted in the present case. It is further submitted that 6 kgs. ganja recovered from his possession is less quantity than the commercial quantity, i.e. 20 kg.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.D.J.-VIth, Bettiah, West Champaran, in Tr.No.38/14 arising out of Inarwa P.S.
