The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. Prosecution case in brief is that petitioner along with other co-accused Gaurav Kumar misappropriated the fund of Rs. 50,05,000/- (Rs. Fifty lakhs five thousand only) of the company M/s Ashirwad Micro-Finance Ltd., Mashrak, Saran by changing the account number of 87 poor females and diverted the same in the account number of their relatives for their personal use.

It is submitted that petitioner was appointed on the post of Field Development Officer and as per Company's circular/guidelines, the job of Field Development Officer is to

No.10884 of 2023(2) dt.27-04-2023 2/2 create business for the organization and when any new business got generated then the Field Development Officers have to report it to the Area Manager as well as to the Branch Head, then it is the duty of the Area Manager and Branch Head to verify the business by making local inspection and verifying the details submitted by the concerned persons. Petitioner has got nothing to do with release or transfer of loan amount to the groups or with collection of the EMI against loan amount. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Mashrakh P.S. Case No. 335 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
