JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 31-01-2022 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State through video conferencing.

The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. The petitioners apprehend their arrest in connection with Chanpatia P.S. Case No. 391 of 2020 registered for offence punishable under sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.

The allegation against petitioner no. 1 is that he assaulted

Patna High Court CR. MISC. No.19447 of 2021(3) dt.31-01-2022 2/2 the informant by farsa on his head and allegation against petitioner nos. 2 and 3 is that they assaulted him with lathi. Only one grievous injury has been found on the person of the informant, which is attributed against petitioner no. 1. The injury is on parietal region of his head, which is grievous in nature. Considering the above mentioned facts and circumstances, the prayer for bail with respect to petitioner no. 1 is rejected.

So far as petitioner nos. 2 and 3 are concerned, their prayer for bail is allowed and they, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatia P.S. Case No. 391 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
