JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 19-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioner seeks bail in connection with Sessions Trial No.394 of 2015, arising out of Nasriganj (Rajpur) P.S. Case No.01 of 2015 registered under Sections 302, 307, 323, 341, 504, 147, 148 and 149 of the Indian Penal Code besides Section 27 of the Arms Act, pending in the court of 3rd Additional Sessions Judge, Rohtas at Sasaram.

The accusation is that on 05.01.2015 at about 11 P.M., the petitioner alongwith 6 others, named in the F.I.R., and three unknown reached near the door of the informant, Mana Singh making firing, and, thereafter, the petitioner assaulted Dhanwarti

Patna High Court Cr.Misc. No.50936 of 2015 (4) dt.19-02-2016 2/2 Devi, the mother of the informant, with the butt of the gun on her mouth. When Anita Kumari, the daughter of the informant came out of the house, the petitioner fired at her and she fell down on the earth. Anita Kumari, the daughter of the informant, was rushed to P.H.C., Rajpur for her treatment but she died. Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
