The petitioner apprehends his arrest in S.T. Excise No.695 of 2018 arising out of Raghopur P.S. Case No.238 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act.
The petitioner is alleged to have carrying 1.2 liter Nepali liquor but seeing the police the petitioner is said to have fled away after leaving his cycle.
The learned counsel for the petitioner submits that petitioner has got no manner of concern with the cycle and the liquor recovered and seized from the cycle.
Considering the aforesaid facts and nature of allegation made against the petitioner and the fact that petitioner was not apprehended on the spot, let the petitioner, above
Patna High Court Cr.Misc. No.8402 of 2019(2) dt.13-02-2019 2/2 named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge II-cum-Special Judge, Excise, Supaul in connection with S.T. Excise No.695 of 2018 arising out of Raghopur P.S. Case No.238 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
