JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned counsel for the informant.

The petitioner apprehend his arrest in connection with Chandauti P.S. Case No. 52 of 2021, registered for the offences punishable under Sections 406, 420, 467, 468 and 34 of the Indian Penal Code.

At the very outset, learned counsel for the petitioner has submitted that the petitioner is ready to refund the entire amount of Rs. 5,00,000/- to the informant but it will be convenient for him to refund the same in installments.

Considering the aforesaid submission, let the petitioner, in

No.9331 of 2022(2) dt.17-08-2022 2/2 the event of his arrest or surrender within four weeks before the learned court below, be released on provisional bail for four months on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.S. Case No. 52 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C and The petitioner is directed to make payment of entire amount to the informant within four months. A monthly installment of Rs. 1,25,000/- shall be paid per month and the entire amount shall be paid within four months. Only after deposit of last installment the bail bond shall be confirmed by the court below itself.

In case the petitioner fails to pay the entire money within the stipulated period, his bail bond shall be deemed to be cancelled. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
