JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 317 of 2017, disclosing offences under Sections 498A/34 of the Indian Penal Code. Prosecution case is that the petitioner is the husband of the complainant. It appears that the matter was referred to the mediation committee twice by this Court for the amicable settlement between the parties but both the time the mediation was failed.
Submission of learned counsel for the petitioner is that the mediation was filed due to exorbitant demand, the petitioner is ready to pay Rs. 2,00,000/- as one time settlement. But O.P. No.2 is demanding Rs. 20,00,000/-, where O.P. No. is

Learned counsel for the APP as well as learned counsel for O.P. No.2 submits that petitioner is big bridal specialist, he has having two flats in Delhi. Having heard both sides, this Court without going into the merits of the claim and as matter relates to the matrimonial relationship, as such let the petitioner above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.
25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, 15th, Muzaffarpur, in connection with Complaint Case No.317 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. However, it is made clear that petitioner will cooperate with the maintenance case and appeal and when required. At the same time, the Family Court, Muzaffarpur will decide the matter within a period of six months.
