The petitioner apprehends his arrest in Banka P.S. Case No.522 of 2018 registered under Sections 363, 366(A) of the Indian Penal Code.

The mother of the victim alleged that her daughter had gone to bring her spectacle from the shop of Prakash Gupta but she did not return. She further alleged that Md. Ansar enticed her daughter for the purpose of marriage. The learned counsel for the petitioner submits that by filing supplementary affidavit, the petitioner has brought on record the statement of the victim recorded under Section 164 Cr.P.C.. The victim disclosed that she went along with the petitioner to Delhi. The petitioner happens to be her maternal uncle but the petitioner did not kidnap her or ill treated with her.

No.9107 of 2019(2) dt.19-02-2019 2/2 Taking into consideration the facts that the victim herself denied the factum of her kidnapping, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No.522 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
