1. Heard learned senior counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Aurangabad Mufassil P.S. Case No. 386 of 2022 dated 13.11.2022 registered for the offence(s) punishable under Section(s) 269, 270, 188, 34 of the Indian Penal Code and Section 77 of Juvenile Justice (Care and Protection of Children) Act, 2015.

The main submissions advanced by the learned senior counsel for the petitioner are that the petitioner is a very young person, the recovery of the objectionable articles detailed in the FIR is completely vague in respect of the place from where the said articles were recovered and moreover the mobile

Patna High Court CR. MISC. No.9886 of 2023(2) dt.04-05-2023 2/2 SIM card, mobile phone, Chewing tobacco, cigarettes etc. are stated to have been recovered from the alleged place and the same were stated to be objectionable articles as per the FIR and the petitioner has been languishing in jail since 14.11.2022 and against him, there are criminal antecedents of two cases in which he is on bail and against him, investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly petitioner's young age and completion of investigation against him, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail in connection with Aurangabad Mufassil P.S. Case No. 386 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
