JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-01-2022 Heard the learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 341, 323, 307 and 302 of the Indian Penal Code, registered in connection with Balua Bazar (Llitgram O.P.) P.S.Case No.29 of 2020. On 20.05.2020 at about 6.00 p.m., the present petitioner along with co-accused Devnandan Paswan was cutting soil which was prohibited by mother of the informant. Both these two accused persons badly assaulted the mother of the informant, who lost her life in the next morning. The learned counsel for the petitioner has submitted that the petitioner is innocent and has not caused any

There is specific allegation against the petitioner and co-accused Devnandan Paswan that they badly assaulted the mother of the informant, who lost her life in consequence whereof.
The learned Additional Sessions Judge-V has mentioned in his order after quoting paragraph no. 53 of the case diary that as per the inquest report the cause of death was assault.
Considering the above facts and circumstances, in my view, it is not a fit case for anticipatory bail. The prayer for anticipatory bail on behalf of the petitioner is hereby rejected. (Nawneet Kumar Pandey, J) HR/- U T
