JUSTICE SUDHIR SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 302, 201 and 34 of the Indian Penal Code. Allegation against the petitioners is of killing father of the informant.

It has been submitted on behalf of the petitioners that they have got no criminal antecedent. Petitioners no. 1 and 2 are in custody since 20.7.2015 and 19.6.2015 respectively.

Chargesheet has been submitted under Section 304 of the Indian Penal Code in the case. There is no allegation of tampering of evidence against the petitioners. In course of investigation witnesses in paras-26 and 27 of the case diary have stated that it was a case of road accident. The doctor, who treated the deceased, has also been examined in para-30 of the case diary. He has stated that he had treated the deceased after the accident and had referred to Sadar Hospital, Kahalgaon.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri A. Shamim, learned Judicial Magistrate, Ist Class, Bhagalpur in connection with Kahalgaon P.S. Case no. 486 of 2013 (G. R. no. 3743/13). (Sudhir Singh, J) sudip/- U T
