The petitioners are apprehending their arrest in connection with Gopalpur P.S. Case No. 97 of 2017 for the offence registered under Sections 304(B), 120(B) and 201/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the present petitioners are father-in-law and mother-in-law of the deceased lady. It is further submitted that the husband of the deceased lady, namely, Lalit Yadav, who was in jail custody, has since been acquitted from all charges levelled against him vide order dated 05.12.2018. It is, thus, submitted that the petitioners,

Patna High Court CR. MISC. No.9676 of 2019(5) dt.26-11-2019 2/2 against whom there is general and omnibus allegation, may be extended the privilege of pre-arrest bail.

Considering the aforesaid facts and circumstances of the case and that the main accused, namely, Lalit Yadav has been acquitted, let the petitioners, above named, in the event of their arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions Judge, Naugachia, Bhagalpur in connection with Gopalpur P.S. Case No. 97 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
