The petitioners are in custody in connection with Special Case No. 10625 of 2019, arising out of P.R. Case No. 248 of 2019, for the offence under Sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 28.11.2019. He further submits that in the instant case total 102.750 litres of foreign liquor was seized. Considering the fact that the petitioners have got no criminal antecedent, the Court is inclined to grant bail to them.

No.7370 of 2020(2) dt.04-02-2020 2/2 The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise , Patna in connection with Special Case No. 10625 of 2019, arising out of P.R. Case No. 248 of 2019. In the event, the petitioners are found involved in similar case in future, the court below shall be at liberty to cancel their bail bonds in the present case.
