In this case, the petitioner is seeking bail in connection with Mahua P.S. Case No. 251 of 2015 for offence under Sections 364/34 & 302, 201, 120(B)/34 of the Indian Penal Code.

An allegation has been made that the Bhagina of the Informant has entered into marriage with one Hasina Khatoon, a married lady, and from their wedlock, the couple was blessed with one child and the lady was also a pregnant lady. An allegation has been made that co-accused Anil Sah and this petitioner connived and killed the victim.

Learned counsel for the State submits that from paragraph no.41 and other paragraphs of the Case Diary, there is

Patna High Court Cr.Misc. No.51385 of 2015 (3) dt.30-01-2016 no direct allegation against the petitioner save and except an illicit relationship with Anil Sah and two others.

Looking to the entire facts available on record, this Court would direct for release of the petitioner, namely, Hasina Khatoon on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hazipur in connection with Mahua P.S. Case No. 251 of 2015.
