====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 Petitioners seek regular bail in connection with Manjhagarh P.S. Case No. 211 of 2019 registered for the offence punishable under Sections 420, 409/34 of the Indian Penal Code.

Allegation as per F.I.R. petitioners was the President of the Ward Nos. 9 and 10 and they have not completed the work of Chief Minister, Gramin Paijal Nischay Yojna and Chief Minister, Gramin Gali Pakki Nischay Yojna. As per the guidelines prescribed under this scheme. It further appears from impugned order that Rs.13677500/- and Rs.8,20,000/- have been spent over the scheme and in measuring 11⁄2 feet pipe has been used in place of 3 feet of the pipe.

No.7316 of 2020(2) dt.25-02-2020 2/2 Submission of the learned counsel for the petitioners is that they have almost completed the work and they are still ready to complete the work as per the guidelines prescribed under the scheme, if they are allowed provisional bail for that purpose. Petitioners are in custody since 04.12.2019. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioners above named, be released on provisional bail for a period of four months on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.S. Case No. 211 of 2019, subject to condition that after release they shall get the work completed and submit a report to the Court below regarding completion of work and on satisfaction of the same the Court below confirm the provisional bail of the petitioner otherwise bail bond of the petitioners shall be cancelled.
