Petitioner seeks bail in connection Itarhi P.S. Case no. 289 of 2020 registered for the offence punishable under sections 25(I-B)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that a country made loaded pistol containing 12 bore live cartridge was recovered from the petitioner and petitioner disclosed that he has purchased the aforesaid country made pistol from one Deepak Koire for Rs five thousand. Learned counsel further submits that petitioner is in custody since 27.12.2020 and he is person with clean antecedent and charge

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 27.12.2020, charge sheet has been submitted and petitioner is a person with clean antecedent, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl.
