JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 394 of 2018, registered for offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the F.I.R. , his name transpired on confession of co-accused and apart from that he is accused in one more case of similar nature.

It has been submitted on behalf of the petitioner that save and except confession of co-accused, there is absolutely nothing against the petitioner. Further, he has no criminal antecedent and he has been in judicial custody since 02.07.2019 and now charge has also been framed in this case. Heard learned A.P.P. also.

Having heard both sides, in view of the submissions

Patna High Court CR. MISC. No.7696 of 2020(2) dt.18-02-2020 2/2 as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XIV, Bhagalpur, in connection with Kotwali P.S. Case No. 394 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court, failing which, the prosecution shall move for cancellation of his bail bonds.

Trial Court is directed to verify the address of the petitioner as well as the address of bailors before releasing the petitioner on bail.
