JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with Itarhi P. S. Case No.212 of 2020 registered for the offences punishable under Sections 379, 413, 414 of the I.P.C.

From bare perusal of the allegation as alleged in the F.I.R., it would manifest that the police on secret information raided the place of occurrence on 26.09.2020 and arrested two persons namely, Ashish Chauhan and Rahul Bhar and recovered a tractor and a motorbike and a mobile. The arrested persons in their confessional statement disclosed the name of this petitioner. Accordingly, F.I.R. was instituted. Learned counsel for the petitioner submits that the

No.19665 of 2021(2) dt.15-11-2021 2/2 petitioner was not arrested at the spot and his name has conspired in the confessional statement of co-accused and nothing has been recovered from the possession of this petitioner. Petitioner is in custody since 26.09.2020 and chargesheet has been submitted. Learned A.P.P. opposes the prayer.

Considering the fact that the charge-sheet has been submitted and there is only one case against this petitioner prior to the present one, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Buxar in connection with Itarhi P. S. Case No.212 of 2020.
