The petitioner would be at liberty to raise the point that during the period that the petitioner was on police bail, he did not misuse the privilege of bail. If the petitioner surrenders and prays for bail, the court below, shall consider the same and would pass orders in accordance with law without being prejudiced with the fact that present petition has not been entertained.
