2. Vide order dated 23.03.2023, passed by this Court in Cr.Misc. No. 64719 of 2022, the bail application of the petitioner was disposed of, observing that if the trial is not concluded within a period of six months, the petitioner may renew his prayer for bail.
3. The learned counsel for the petitioner has submitted that till date the trial has not been concluded.
4. A report was called for from the learned court below along with the deposition of the witnesses, examined if any. The report is available with the record which shows that till date altogether six witnesses have been examined, but none has supported the prosecution case. It also appears from the report
Patna High Court CR. MISC. No.10243 of 2025(3) dt.20-06-2025 2/2 that since 27th June, 2023, no witness turned up on behalf of the prosecution. The petitioner is in custody since 05.01.2019.
5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II, Begusarai in connection with Nowkothi P.S.Case No. 33 of 2003/S.T.No.408 of 2019, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date fixed at the trial, and if he fails to appear on two consecutive dates, unless he is prevented by extremely adverse circumstances, the court below shall be at liberty to cancel his bail bond.
