JUSTICE RAVI RANJAN ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Section 394 of the Indian Penal Code. It is submitted on behalf of the petitioner that he is not named in the FIR and the recovered motorcycle is registered in the name of his mother and as such, the same has been released vide Annexure-2 appended with the supplementary affidavit. It is further submitted that the petitioner was not apprehended from the spot and he has been implicated on the basis of his alleged self incriminating confessional statement. He is in custody since 27.07.2015 having no criminal antecedent.

Having regard to the aforementioned facts and circumstances, the petitioner, namely, Suman Kumar @ Nikil

Patna High Court Cr.Misc. No.52413 of 2015 (2) dt.15-12-2015 2/2 Anand is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No.620/2015, with a further condition that one of the bailors must be his father.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. (Dr. Ravi Ranjan, J) V.K. Pandey/- U T
