JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

As per the prosecution case, petitioner obtained appointment on the post of panchayat teacher on the basis of forged and fabricated educational certificates. It is submitted that after verification of documents by the competent authorities, petitioner was appointed on the post of panchayat teacher. The appointment of petitioner has been upheld by the State Appellate Authority vide order dated 02.08.2022. Subsequently, fresh appointment letter has been issued in favour of the petitioner. Patna High Court CR. MISC. No.9338 of 2023(2) dt.25-04-2023 2/2 21.02.2022 on the basis of which this FIR has been lodged, has already been quashed by State Appellate Authority. The petitioner is a lady and claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Govindganj P.S. Case No.451 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
