JUSTICE SUDHIR SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 11.07.2015 in connection with Shahkund (Sajour) P.S. Case No. 153 of 2011 for the offences instituted under Sections 364, 302 and 201/34 of the IPC.

The accusation is of killing the so-called daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.07.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. The present case was instituted on 01.09.2011 by the petitioner in respect to abduction

Patna High Court Cr.Misc. No.42092 of 2015 (3) dt.15-10-2015 2/2 of his step-daughter. After a period of four years in the year 2015, the petitioner has been made accused in the present case merely on suspicion as he happens to be the step-father of the victim. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest his implication in the present case.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhagalpur, in connection with Shahkund (Sajour) P.S. Case No. 153/2011 (G.R. No. 2256/2011).
