====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Tikari P.S. Case No. 255 of 2018, instituted for the offence under Section(s) 341, 323, 452, 504, 506, 376 and 511/34 of the Indian Penal Code. Counsel for the petitioner submits that both parties are Gotiyas and next door neighbours. There is no eye witness of the case. Prior to the date of aforesaid occurrence, on 8.7.2018 some occurrence had taken place with father of the petitioner and informant family, for which, complaint case was filed by father of the petitioner vide Complaint Case No. 1296 of 2018. The instant case has been filed as counter blast levelling allegation that on the date of occurrence, the petitioner after entering into the house of the informant
Patna High Court Cr.Misc. No.10446 of 2019(2) dt.21-02-2019 2/2 attempted to outrage her modesty.
It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent.
Petitioner is said to be in custody since 14.9.2018. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya, in connection with Tikari P.S. Case No. 255 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
