Mr. Dashrath Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-01-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State through video conferencing.
The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.
The petitioner apprehends his arrest in connection with Bhabua P.S. Case No. 538 of 2020 registered for offence punishable under sections 147, 148, 149, 279, 323, 337, 307, 427, 504 of the Indian Penal Code and section 27 of the Arms Act.
As per FIR, the stone chips loaded tractor collided with the pillar of informant. When the informant asked, the

Co-accused Chandan Singh also fired two shots, but it did not hit the informant. Co-accused Ravi Patel has also assaulted him on his nose by hockey stick. The brother of the informant also injured.
The learned counsel for the petitioner has submitted that there is case and counter case and the persons of petitioner side have also sustained injuries. He has further submitted that although one injury on the nasal of the informant was found grievous, but it has not been attributed to the present petitioner, rather it has been attributed to the co-accused Ravi Patel. The other injuries on the persons of informant and his brother are simple in nature caused by hard and blunt substance. Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur (Bhabha) in connection with Bhabua P.S. Case No. 538 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the
Patna High Court CR. MISC. No.19456 of 2021(2) dt.22-01-2022 3/3 petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
