JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the name of petitioner surfaced in confessional statement of co-accused and after that petitioner was arrested and from his possession one mobile phone and two SIMs were recovered. The call details of the aforesaid SIMs were verified and it was found that petitioner was in constant touch with other co-accused prior to the alleged occurrence and petitioner also confessed his guilt. It appears that except the aforesaid material as well as criminal antecedent of the petitioner, there is nothing against him. The investigation against the petitioner has already been completed.

Patna High Court Cr.Misc. No.32913 of 2015 (3) dt.15-10-2015 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 5th Additional Sessions Judge, Muzaffarpur in connection with Brahampura P.S.Case No. 208 of 2014, session trial no. 38 of 2015.
