Mr. Atul Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is in custody in connection with Hajipur Town P.S. Case No. 817 of 2018 for the offences under Sections 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 17.11.2018. He further submits that the petitioner was not named in the F.I.R. his name surfaced in the further statement of the informant. He further submits that the petitioner is 40 years old whereas the description of the miscreants was aged about 25 to 30 years.

Considering the aforesaid, the Court is inclined to

Patna High Court Cr.Misc. No.8509 of 2019(2) dt.13-02-2019 2/2 grant bail to the petitioner, let the petitioner named above be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur (Town) P.S. Case No. 817 of 2018.
