JUSTICE MUNGESHWAR SAHOO ORAL ORDER 20-02-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, namely, Rameshwar Singh is in custody since 23.07.2014 in Saraiya P.S. Case No.152 of 2007, Sessions Trial No.304 of 2011 under Section 304B/201/34 I.P.C. and 3/4 of Dowry Prohibition Act.

The learned counsel for the petitioner submitted that the petitioner is the father-in-law of the deceased. The husband of the deceased i.e. son of the petitioner against whom same allegation was made has already been granted bail by this Court in Cr. Misc. No.38412 of 2009 on 29.01.2010. The learned counsel further submitted that the age of the petitioner is about 70 years and he resides in Delhi.

Patna High Court Cr.Misc. No.48543 of 2014 (2) dt.20-02-2015 Considering the above facts and circumstances of the case that the husband has already been granted bail by this Court in Cr. Misc. No.38412 of 2009 on 29.01.2010, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.10,000(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge, Muzaffarpur in connection with Saraiya P.S. Case No.152 of 2007, Sessions Trial No.304 of 2011.
