The petitioner, namely, Ram Vijay Singh @ Ran Vijay Singh is in custody since 03.07.2014 in Amas P.S. Case No.93 of 1999 under Section 364(A) of the I.P.C. It appears that F.I.R. was lodged by the informant alleging that his son did not return from the school and the informant suspected that four named persons might have kidnapped his son with intention to kill him because there is dispute between them.
The learned counsel for the petitioner submitted that the petitioner is not named in the F.I.R. The case has been filed in the year 1999 and, therefore, the petitioner had no knowledge about the case. The police recorded the statement of the informant
Patna High Court Cr.Misc. No.48544 of 2014 (2) dt.20-02-2015 at paragraph 22, wherein he raised suspicion against this petitioner also and except this suspicion, there is nothing against the petitioner in the case diary.
On the other hand, learned A.P.P. objected the prayer for bail on the ground that the son of the informant is still traceless.
From perusal of the F.I.R., it appears that the only allegation is that the informant suspected that the named F.I.R. accused persons might have kidnapped with intention to murder his son. Likewise, subsequently, he raised the suspicion against this petitioner also. Except this, there is nothing on record, as would be evident from the order passed by the Additional Sessions Judge 8th, Gaya.
Considering the above facts and circumstances of the case, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.10,000(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the court of Sri Rajiv Kumar, learned Judicial Magistrate 1st class, Sherghati, District Gaya in connection with Amas P.S. Case No. 93 of 1999.
