The petitioners seek bail in anticipation of their arrest in connection with Terhagachh P.S. Case No. 98 of 2020 instituted for the offences under Sections 341, 323, 307, 427, 448, 380, 504, 506/34 of the Indian Penal Code. They are brothers amongst themselves and are also full brothers of the informant, who are alleged to have assaulted the informant. So far as the petitioners are concerned, they are said to have specifically assaulted their nephew, namely, the son of the informant (Abu Raza) but he

Patna High Court CR. MISC. No.19276 of 2021(2) dt.11-03-2022 2/2 has received only one injury which has been reported to be simple in nature.

The learned counsel for the petitioners has submitted that because of long standing family dispute, all the members of the family have been made accused in this case.

Regard being had to the background facts and afore-noted submissions, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Kishanganj, in connection with Terhagachh P.S. Case No. 98 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
