JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Kishanganj P.S. Case No. 130 of 2019 for offences under Sections 147, 148, 149, 224, 225, 341, 342, 333, 353, 427, 384, 387, 364, 379, 307, 504, 506 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The allegation against him is that he was involved in taking Rangdari for trespassing of the loaded truck. When the police reached the place of occurrence, several persons gathered and attacked on the police party with arms and ammunition which caused injuries to the police personnel. Considering the fact that the petitioner has no criminal antecedent, this Court is inclined to grant bail to him. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 130 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
