The petitioner, who is languishing in custody, seeks bail in a case registered under sections 307, 325, 324, 342, 341, 147, 148 and 149 of the Indian Penal Code.
In this case, instituted against five named, petitioner's name appears emerging during investigation in the statement of injured father of the informant from where also it appears that the petitioner is not the assailant rather at his instance others have assaulted the solitary injured. Further he carries no criminal antecedents except Bihara P.S. Case No.131 of 2013 wherein he is on bail.
If it is so, the petitioner above named is directed to
Patna High Court Cr.Misc. No.48316 of 2014 (2) dt.20-02-2015 2/2 be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Bihra P.S. Case No.51 of 2014, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
