The petitioner seeks regular bail in connection with Maner PS case no. 15 of 2019 registered for the offence punishable under Sections 379, 411 of Indian Penal Code, 4/40 of Bihar Mining Act, 1972 and 3, 6, 8 of Bihar Mineral of Prevention of Illegal Mining Transportation and Storage Act, 2003.

The allegation is regarding recovery of 100 cu. ft. of sandy soil loaded on a tractor and when the petitioner was apprehended, he disclosed that he is merely the driver of the tractor.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present

Patna High Court Cr.Misc. No.10591 of 2019(2) dt.22-02-2019 2/2 case. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since 08.01.2019. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Danapur, Patna in connection with Maner PS case no. 15 of 2019.
