The petitioner seeks bail in connection with Vishambharpur P.S. Case No. 70 of 2019, registered under Sections 272, 272 and 308 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016. The accusation is that on receiving secret information about carrying the country made liquor loading on motorcycle and four wheeler, the informant, along with other police personnel, reached at Siswa Market and started checking the vehicle. At that time, one white colour car was seen. On seeing the police party, two persons started to flee away from car while on chase one was apprehended, but, other succeeded to flee away. Caught hold person disclosed his name Bullet Prasad and also disclosed the name of his associate succeeded to flee away
Patna High Court CR. MISC. No.9762 of 2020(2) dt.28-02-2020 2/2 Bittu Kumar. On search of car, 14 cartons, each containing 45 bottles of 200 ml country made liquor recovered. Submission is that the petitioner has no criminal antecedent and he was apprehended by the police mere on suspicion. The petitioner is in custody since 24.12.2019. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Vishambharpur P.S. Case No. 70 of 2019 to the satisfaction of the Additional District Judge II-cum-Special Judge, Excise, Gopalganj.
