In this case, the petitioner is seeking bail in connection with Dighal Bank P.S. Case No. 38 of 2012 registered for offences under sections 363/366(A)/34 of the Indian Penal Code.

Allegation has been made in the first information report that two girls, namely, Rabina Khatoon and Zulekha Begam had gone to Kajla Chowk but they did not return. The informant has indicated suspicion to Radhe Shayam Mishra about taking away both the girls.

When both the girls were recovered, their statements were recorded under sections 164 Cr.PC. implicated the petitioner and another Javed @ Md. Jebed.

This Court, vide order dated 26th November 2015 in

Patna High Court Cr.Misc. No.51132 of 2015 (4) dt.17-02-2016 2/2 Cr. Misc. No. 46599 of 2015, granted bail to Javed @ Md. Jebed. The counsel for the petitioner submits that the case of the petitioner is identical to the case of Javed @ Md. Jebed. In such view of the matter, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Dighal Bank P.S. Case No. 38 of 2012, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner and (ii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates without any valid reason, the court below will be at liberty to pass the order, including cancellation of bail bonds.
