The petitioner apprehends his arrest in Manjhagarh P.S. Case No. 30/2016, registered for the offences punishable under Section 304 of the Indian Penal Code and Section 3(1)(VI)2(V) of S.C./S.T. Act.
The informant alleged that his father had gone to graze Pig, but his father touched the fencing wire of the field of the petitioner and he died on account of electrocution. It is submitted that petitioner has not committed any offence he has no knowledge that electric current was flowing in the fencing of his field. Petitioner has no altercation with the informant.
Considering the facts aforesaid and the fact that the
Patna High Court Cr.Misc. No.25008 of 2016 (4) dt.18-08-2016 2/2 informant himself stated that his father touched the fencing wire of the field of the petitioner and died and that the petitioner was not present at the place of occurrence, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.S. Case No. 30/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
