The petitioner seeks bail in connection with Buxar Muffasil P.S. Case No. 258 of 2023 instituted for the offence under Section 392 of the Indian Penal Code.

As per prosecution case, informant was accosted with unknown miscreants when he was on his way. Thereafter, they threatened the informant to kill and snatched purse, gold chain and Rs. 1000/-.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20-10-2023. Petitioner

Patna High Court CR. MISC. No.11773 of 2024(2) dt.26-02-2024 2/3 bear three criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Name of the petitioner has been surfaced in this case due to confessional statement of co-accused, namely, Manmohan Chauhan, and the same has no evidentiary value. Motorcycle has been recovered from the pond of one 'Guddu Paswan'. Nothing has been recovered from the conscious possession of the petitioner. No T.I. parade has been conducted in this case. One co-accused has been allowed anticipatory bail by a Coordinate Bench of this Court vide order dated 21-02-2024, passed in Cr. Misc. No. 4223 of 2024.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and manner of implication, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Buxar
