01-12-2015 Heard Sri Naresh Prasad, learned counsel for the petitioner and Sri Shailendra Kr. Singh, learned Addl. Public Prosecutor.
The petitioner, who is in custody since 15-09-2015 in Ashok Paper Mill P.S. Case No. 182 of 2013 registered for the offence under Sections 420, 465, 486 and 471 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that initially, the informant of the present case had filed a complaint case before the court of learned Chief Judicial Magistrate on an allegation that the petitioner alongwith other, by way of forging signature, had filed an affidavit in a case before the
Patna High Court Cr.Misc. No.51905 of 2015 (3) dt.01-12-2015 2/2 Supreme Court. Subsequently, the complaint was referred to the police under Section 156(3) of the Cr.P.C. and thereafter, an F.I.R. was lodged. It was argued that the petitioner has falsely been implicated in the present case.
Learned Addl. Public Prosecutor has opposed the prayer of bail.
However, keeping in view the period of custody and nature of accusation, let the petitioner namely Sharda Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Darbhanga, District Darbhanga/concerned court in connection with Ashok Paper Mill P.S.Case No. 182 of 2013.
