2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 303(2), 76, 77, 352, 351(2)(3), 329(4), 324(4)(5), 3(5) Bharatiya Nyaya Sanhita.

3. As per prosecution case, on 17.07.2024, when informant was taking bath, petitioner No. 2 was making videos of her while bathing and when informant protested and snatched the mobile phone, she found that petitioner No. 2 was on video call with co-accused Chandan Kumar. It is further alleged that in course of the incident, co-accused Sanoj Paswan

Patna High Court CR. MISC. No.9573 of 2025(2) dt.20-02-2025 2/3 assaulted informant on chest and petitioner No. 1 snatched the mobile phone.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Present case is counter blast of Complaint Case No. 99 of 2024 which was lodged by petitioners and others against informant and others and in retaliation, this false and concocted case has been lodged against petitioners. Moreover, there is delay of five days in lodging the F.I.R. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Sheohar in connection with Shyampur Bhataha P. S. Case No. 75 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita,
