03-03-2015 Heard Sri Pramod Kumar Pandey, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, who are in custody in Raxaul P.S. Case no.174 of 2014 registered for the offence under Sections 447, 341, 323,324,325, 307, 379, 504/34 of the Indian Penal Code, have prayed for grant of bail.

Learned counsel for the petitioners, while pressing the petition, submits that there were case and counter case in between both sides. Earlier one of the accused of the present case had lodged a case against the informant and others of the present case vide Raxaul P.S. Case No.173 of 2014 registered for the offence under Section 341,323,307, 379/34 of the Indian Penal Code. It

Patna High Court Cr.Misc. No.49388 of 2014 (2) dt.03-03-2015 2/2 has been argued that petitioner no.1 is in custody since 31.07.2014 and petitioner no.2 is in custody since 01.09.2014. Keeping in view the fact that there were case and counter case as well as keeping in view the period of custody, let both petitioners, namely, (i) Khursid Mian and (ii) Sultan Mian be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari in connection with Raxaul P.S.
