The slip for listing was filed pursuant to notice dated 08th May, 2019, published prior to the vacation.

The matter is, accordingly, taken up for consideration as both parties are present and willing to assist the court for disposal of the matter.

Heard counsel for the petitioner and counsel for the respondents-State.

Short submission of counsel for the petitioner is that the

Patna High Court CWJC No.10134 of 2018(2) dt.23-05-2019 2/2 petitioner's claim for appointment has not been considered whereas persons below him in the panel prepared in 2017 have been granted benefit of appointment as retrenched census employees. Counsel for the petitioner further submits that this court may direct respondent no.3 to consider the said grievance which has been raised by representation which are contained in Annexure 4 series to writ petition.

Claim of the petitioner has to be considered by the authority concerned having regard to various factors with claim of others who are impanel. It is agreed that issue may be considered by respondent no.3 pursuant to Annexure 4 series. No useful purpose will be served keeping writ petition pending. Accordingly, respondent no.3 (The District Magistrate, Muzaffarpur) is directed to dispose off petitioner's representation (Annexure 4 series) by reasoned and speaking order in accordance with law within three months from the date of receipt/production of a copy of this order.

Writ petition is disposed off.
