The petitioner seeks bail in Goraul P.S. Case No. 423 of 2021, registered for the offence punishable punishable under Sections 272, 273 of the Indian Penal Code and sections 30(a), 32(II), 38(2) and 41 (1) of the Bihar Prohibition and Excise Act, 2016.
Total 63 litres of illicit liquor has been recovered from different vehicle, out of which 9 litres of foreign liquor has been recovered from motorcycle of this petitioner. It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the seized liquor. Petitioner is in custody since 30.10.2021

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge Excise Act, Vaishali at Hajipur in connection with Goraul P.S.
