The petitioner seeks regular bail in connection with Kahalgaon (Ghogha) P.S. Case No. 03 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 188 and 290 of the Indian Penal Code.

The allegation is regarding recovery of 112 litres of illicit liquor from the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge-cum-Special Judge,Excise, Bhagalpur in connection with Kahalgaon (Ghogha) P.S.
